π΅ Flat fee real estate agent: the short answer
A flat fee real estate agent charges an amount stated in the agreement rather than automatically tying the fee to the sale price. A percentage commission rises or falls with the transaction price. The cheaper-looking option is not necessarily the lower-cost option after photography, showings, offer review, negotiation, contract management, cancellation fees, and closing support are counted.
Under NAR's 2026 MLS policy, an MLS Participant working with a buyer must use an objectively ascertainable compensation amount or method in the written agreement and disclose that broker fees are negotiable and not set by law. This is an MLS policy with a defined scope, not a federal fee schedule for every real estate professional. Review NAR Policy Statement 8.13 and the law in the state where the property is located.
π How the two fee models compare
A percentage fee is generally calculated as transaction price Γ agreed percentage. On an $800,000 transaction, 2.5% equals $20,000. If a flat-fee package is $7,500, the advertised difference is $12,500. That arithmetic does not show whether both agreements include the same work.
- Flat fee: The base fee may remain unchanged as the price changes
- Percentage: Compensation changes with the final transaction price
- Hybrid: A base charge plus a success fee or separately priced services
- Minimum fee: A percentage subject to a stated minimum charge

Calculation details and assumptions
The percentage total equals price Γ the entered percentage. The flat total equals the entered flat fee plus add-ons. A positive difference means the modeled flat total is lower; a negative difference means it is higher. Included services, other transaction costs and negotiated terms may differ. This calculation does not guarantee savings or quote any provider's fees.
β Compare services, not labels
Questions for a seller
Does the package include pricing analysis, professional photos, listing copy, MLS placement, showing management, offer comparison, repair negotiation, appraisal support, and closing coordination? A limited-service listing may leave the seller responsible for buyer inquiries and contract work.
Questions for a buyer
Does the agreement cover property search, a stated number of tours, comparable-sales analysis, offer drafting, inspection response, appraisal issues, final walk-through, and closing? NAR notes that the relationship, term, services, and fee model can be negotiated by the parties. See Written Buyer Agreements 101.
Contract checklist
When a flat fee may fit
It may fit when the needed services are clearly defined, the client can handle some tasks, and the all-in amount remains predictable under realistic scenarios. A seller with a straightforward property and strong scheduling skills may value that control.
A more complex transaction may require extensive coordination around title, multiple offers, repairs, appraisal gaps, or a compressed closing. In that situation, compare experience and scope before comparing price. The CFPB also recommends checking an agent's experience in the relevant neighborhoods, price range, and property type and asking for references. CFPB agent-selection guidance
Flat fee real estate agent FAQ
Q.Is a flat fee guaranteed to stay the same?
The base amount can remain fixed if the contract says so. Optional services, cancellation, relisting, and charges due after an unsuccessful transaction may still change the total.
Q.Is there a legally required percentage commission?
No single commission percentage is set by law. For covered MLS Participants, NAR policy requires a conspicuous statement that broker fees are negotiable.
Q.Does the lowest flat fee always save the most?
No. The client may have to purchase excluded services or assume work and risk that a fuller package would cover.
Q.What numbers should I request before signing?
Ask for the base fee, add-on rates, upfront payment, cancellation charge, and amount owed if the transaction fails to close.
Flat fee real estate agent: final decision
A flat fee real estate agent should be compared with a percentage model using the same service list and the same transaction scenarios. Put compensation, add-ons, termination, and response standards in writing. Comparing at least two proposals side by side is more useful than choosing from a single advertised number.
Contract requirements vary by state and brokerage. Use the signed agreement and applicable state guidance as the controlling sources.
