Pinkmelon, Inc. ("Pinkmelon" ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our services.

Pinkmelon, Inc. is a licensed California real estate brokerage (CalDRE License #02446566) with its principal place of business at 3435 WILSHIRE BLVD STE 1960, Los Angeles, California. We provide brokerage services in Los Angeles County and Orange County, California.

Pinkmelon is not a mortgage lender or financial institution. Any mortgage-related tools on this site are for informational purposes only. If you choose to contact a mortgage lender or broker, you do so directly, and that provider’s own privacy policy will govern its collection and use of your information.

2. Information We Collect

2.1 Information You Provide Directly

• Name, email address, and phone number submitted via contact forms, early access sign-ups, or consultation requests
• Property-related information (desired location, price range, buying/selling intent)
• Financial inputs entered into our mortgage or savings calculators (not stored on our servers) — where such inputs include income, credit, or other financial details, they are treated as sensitive personal information under the CPRA (see Section 7)
• Communications you send to us via email or contact forms

2.2 Information Collected Automatically

• IP address, browser type, device type, and operating system
• Pages visited, time on site, referral source (UTM parameters), and click behavior
• Usage and behavioral data collected through analytics tools to help us understand how users navigate our site and improve the experience
• Cookies and similar tracking technologies (see Section 7)

2.3 Information from Third Parties

• Aggregated usage and behavioral data from third-party analytics tools, used solely to improve our website and user experience
• Ad performance and attribution data from digital advertising platforms
• MLS (Multiple Listing Service) and real estate data platforms — property and listing information associated with properties you inquire about
• Public records — property ownership, tax, and other publicly filed records

Categories under the CCPA. The information described above corresponds to the following statutory categories: identifiers; personal information under Cal. Civ. Code §1798.80(e); commercial information; internet or other electronic network activity; geolocation data; sensitive personal information (financial information); and inferences drawn from the foregoing.

3. How We Use Your Information

We use your information to:

• Respond to your inquiries and connect you with a licensed Pinkmelon agent
• Provide the real estate brokerage services you have requested
• Send you updates about Pinkmelon services and announcements, with your consent
• Improve our website, features, and user experience through aggregated analytics
• Analyze marketing performance and attribution
• Prevent fraud and maintain platform security

We do not sell your personal information. We do not sell or share personal information for cross-context behavioral advertising, and we have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age. We do not use sensitive personal information for purposes other than those permitted under the CPRA.

4. How We Share Your Information

We may share your information with:

• Real estate professionals involved in your transaction
• Service providers acting on our behalf under contract — website hosting, email and SMS delivery, CRM and customer support, analytics, transaction management, and e-signature platforms
• MLS and real estate platforms — to list your property or facilitate your property search, as required to provide core brokerage services
• Escrow, title, and closing service providers where necessary to complete a transaction you have initiated
• Regulatory authorities (California DRE, law enforcement) when required by law or to protect our legal rights
• Successors in interest — in the event of a merger, acquisition, or sale of assets, subject to equivalent privacy protections

We do not share your information with unaffiliated third parties for their own marketing purposes without your explicit consent.

We do not transfer your personal information to mortgage lenders. If you choose to inquire about mortgage or financing services, you must contact that provider directly, and their privacy policy will govern.

5. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes outlined in this policy or as required by law. California Department of Real Estate regulations require us to retain records relating to real estate transactions for a minimum of three (3) years from the date of closing or termination of the transaction. Contact and marketing data is retained until you withdraw consent or request deletion, subject to applicable legal retention obligations.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to record your preferences, track how our site is used, and collect information to improve your experience and support our marketing efforts.

We use the following categories of cookies:

• Strictly necessary — required for the website to function; these cannot be disabled
• Analytics — help us understand how visitors use the site; you may opt out through your browser settings or the applicable provider’s opt-out tool
• Marketing and attribution — used to measure advertising performance; you may opt out through the Digital Advertising Alliance at optout.aboutads.info

Do Not Track (DNT). Our website does not currently respond to DNT signals from browsers.

Global Privacy Control (GPC). We recognize and honor GPC signals from supported browsers as a request to opt out of the sale or sharing of personal information, to the extent technically feasible.

7. Your California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):

• Right to know. Request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of that information, our purposes for collecting it, and the categories of third parties to whom we disclose it.
• Right to delete. Request deletion of personal information we have collected from you, subject to legal exceptions including the DRE record-retention requirements described in Section 5.
• Right to correct. Request correction of inaccurate personal information we maintain about you.
• Right to opt out of sale or sharing. Direct us not to sell or share your personal information for cross-context behavioral advertising. We do not currently sell personal information; however, certain advertising technologies may constitute "sharing" under the CPRA. You may exercise this right through the "Do Not Sell or Share My Personal Information" link in our website footer.
• Right to limit use of sensitive personal information. Request that we limit our use of sensitive personal information, including financial information, to purposes necessary to provide the services you requested.
• Right to non-discrimination. We will not deny services, charge different prices, or provide a different level of service because you exercised any of these rights.

How to submit a request

We will verify your identity before processing your request, using information reasonably necessary to confirm that you are the person about whom we collected personal information. We will respond to verifiable requests within forty-five (45) days, with one additional 45-day extension where reasonably necessary and with prior notice to you.

You may designate an authorized agent to submit a request on your behalf. An authorized agent must provide written authorization signed by you, and we may require you to verify your identity directly with us.

Notice of financial incentive

Pinkmelon’s 1% listing fee and buyer cash back are not conditioned on the collection of personal information beyond what is necessary to provide brokerage services. We do not offer different prices or service levels based on whether you provide personal information beyond what is required.

8. Children’s Privacy

Our website and services are not directed to individuals under 18 years of age, and we do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us at privacy@pinkmelon.ai and we will delete it promptly.

9. Security

We use appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure; if a data breach occurs, we will notify affected users in accordance with applicable law, including California Civil Code §1798.82.

10. Changes to This Privacy Policy

This policy may be updated from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Where changes are material, we will provide additional notice through the website or, where we have your email address, by email. Your continued use of our website or services following the posting of changes constitutes acceptance of the revised policy.
